By participating in the Adversal.com ("Adversal") program, you are
agreeing to be bound by these terms. An approved website for participation on
Adversal Publisher Network will herein be referred to as Publisher
("Publisher"). Any persons that purchase advertising from Adversal,
it's partners and affiliates, or any other company associated with Adversal will
herein be referred to as Customers of Adversal ("Customers of Adversal").
PUBLISHER INCLUSION
Publishers must meet the following guidelines for acceptance into Adversal
Publisher Network: Applying site
- must have a functional layout and adequate design
- must contain original content and comprise of at least two pages
- must be written in English
- must have it's own domain name
- must not contain excess advertising
- must not contain or link to adult content
- must not contain or participate in illegal,
hate, or otherwise legally questionable activity
- excessive vulgar language
-
depictions or undertones of violence
- software
piracy (warez, cracking, serials, distribution of copyrighted material,
etc.)
- contain such information as how
to build home detonation devices, weapons,
malicious hacking, cons/scams, etc.

endorsement of illegal drugs and/or drug
paraphernalia
- any other content that
can be deemed legally questionable
- must not be under construction or incomplete
- must not be associated with spam in any way, shape, or
form
- must not host or provide links to downloadable music files (mp3, wmv, etc.)
- must not be associated with spyware/adware in any way, shape, or
form including the association, distribution, or delivery of
ads through any downloadable utility that can be
mistaken as, taken for, or otherwise concluded
to be adware
- must not distribute viruses
- may not be or participate in any incentive based programs or paid-to operations
(paid-to-click, paid-to-surf, paid-to-read, etc.)
- may not be a manual or auto surf exchange
- may not be a forum, or host a forum for primary functionality
- must use the publisher code provided properly as defined upon
approval
- cannot place Adversal's publisher code on any page that simultaneously launches additional
pop-up/under windows.
It is the publisher's responsibility to maintain content in acceptance with these
guidelines. Adversal reserves the right to suspend an account and withhold
payment from any publisher found to be sending invalid, fraudulent, and/or low performing traffic in addition to any violation listed within these terms. In the event of a
violation, Adversal reserves the right to immediately
suspend an account without publisher notification.
TRAFFIC REQUIREMENT
Publisher sites are required to have a minimum of 2,500 page views per month and maintain 50% North American traffic.
REPORTS
Adversal shall be the sole owner to all statistical data collected as a result of
Adversal Publisher Network.
LOGGING
Adversal's code will in fact break through most pop-up blockers, however, it is
still possible to defeat our code through extensible work a rounds. Furthermore,
we will not show pop-unders to IP addresses of public anonymous proxy servers. In
the event that no pop-under is shown for any reason, a payable page view will not
be logged.
FRAUD
Adversal retains that right to permanently suspend and withhold payment of any
publisher found to be fraudulently creating page views.
PRIVACY
Adversal at no time will share, sell, or otherwise release your personal
information (name, email address, home address) partially or in its entirety to
any third party unless strictly required to by law as a direct result of such
proceedings as a court order or a legal process.
PAYMENT
Payment shall be issued in the form of a check or PayPal payment for amounts of
$20 or more payable in USD on the fifteenth of the month or the subsequent first
business after the fifteenth, should the fifteenth fall on a weekend. No check or
PayPal payment will be issued for amounts less than
$20USD. Unpaid balances will rollover to the next month.
All accumulated totals are based on the actual
rates assigned to your account. Publishers are responsible for
keeping their contact/payment information up to date so that PayPal/check payments
can be delivered. Information can be updated through means of the Adversal website. Any fee associated with a cancelled or returned payment
directly to do with publisher's failure to provide up to date contact/payment
information will be deducted from the publisher's payable amount.
WARRANTIES
Adversal is not responsible or liable for content delivered through third parties
(advertisers). Furthermore, Adversal makes no warranty whether express, implied,
or statutory. Any legal liability stemming from a publisher's website or it's
content is the sole responsibility of the publisher. Upon obtaining an approved
publisher account, publisher agrees to indemnify, defend and hold Adversal
harmless including its parent, officers, agents, directors, affiliates and
employees from and against all claims, damages, actions, losses, liabilities,
expenses, and costs that may at any time be incurred by reason of any claims.
LIMITATION OF LIABILITY
The customers of Adversal nor Adversal itself can be held liable for delays or
failure of delivery of a pop-under, content errors, or website errors do to, but
not limited to, Internet problems, server problem, technical failures, customer
problems (including violations to the advertiser guidelines).
PAYMENT CALCULATION
Calculation of Publisher earning based on page views and country origin will be
the sole responsibility of Adversal.
DAMAGES
No party (Adversal, Publisher, Customers of Adversal) shall held liable in any
way whatsoever for reasons, but not limited to, loss of use, profits, and/or data.
CHANGES
Adversal reserves any and all right to change these terms at any time without
notices. Your continuance in Adversal Publisher Network signifies that you are in
compliance and agreement with these terms.
